Non-resident

To be counted as a non-resident in Spain, there are some requirements that you must meet. Firstly, a non-resident will in almost all cases have a NIE number. A NIE number(Número de Indentidad de Extranjero) is a form of identification number which Spain uses to register you.

Foreign nationals whose economic, professional or social interests make them liable to be identified with Spain will be assigned a personal, unique and exclusive number in sequence.


Resident

A resident in Spain is someone who has his domicile, residence and/or main residence in Spain. However there are 2 forms of residency and actually they go almost hand in hand with each other.

There is tax residence on the one hand and legal/administrative* residence on the other (*we call it legal/administrative as we cannot find a more specific term).


Fiscal residency

You will stay more than 183 days + 1 day in Spain and therefore the Spanish tax authorities will consider you as tax resident. The Spanish tax authorities expect you to do your tax declaration in Spain and whether or not you will be taxed on your world income.


Legal/administrative residence

You have decided that Spain will be your country of residence and you have transferred all your administrative matters to Spain. Your new contact point for your personal administration of your nationality will be the AMBASSADE or the CONSULAAT and you will have to arrange your Spanish administrative affairs through the Spanish governmental authorities.
