If you wish to make use of our purchase and sale guidance, you can count on an independent partner who will assist you before, during and after the purchase or sale of your home.

For this service Segurantis always works with an independent lawyer who has no relation to the real estate office or the promoter. Segurantis acts as case manager who will defend and promote your interests together with the lawyer .

An overview of the tasks our team checks for you during this process:

  • Drafting, co-drafting and reviewing or assessing the preliminary sale/purchase agreement - Compromise Compromise
  • Performing a cadastral search into the name and legal capacity of the home and/or the plot
  • Conducting an investigation into any mortgages, other debts or attachments resting on the property
  • Investigate any debts with taxes, utility companies and, if applicable, with the Home Owners Association
  • Legally required representation regarding legal and fiscal aspects of the purchase/sale
  • Financial settlement of the purchase and sale, this means a BREAKDOWN of the amounts to be paid for the purchase, transfer tax, notary, etc. You have to take into account that on the price of the purchase you have to add a margin of 11%-13% to bridge these costs (the costs of the legal purchase assistance are already included in this). Take into account a margin of 2%-6% when selling a property.
  • Preparation of the transport deed at the notary in consultation with the selling/buying party
  • We accompany you to the notary, which you as purchasing party may choose* (we always use our regular notary in Playa Flamenca), provide support and translation at the notary and ensure that everything is in order in your favor.

With bank attachments this is different and the bank will work with its local permanent notary.

  • Verbal translation of the deed of conveyance at the notary - required by law
  • Update property tax payments and transfer them to the name of the new owner - registration in the land register
  • Withholding, declaration and payment of 3% "profit tax" to the detriment of the selling party if non-resident
  • Registration of the deed of conveyance in the Property Register
  • Transfer of contracts for water and electricity (and possibly gas)
  • Set up insurance according to your requirements and at a realistic price (no insurance through the bank; it is expensive and not in line with reality)
  • Notification of transfer to the Owners' Association (if applicable)
  • After the purchase, advise you on your legal and fiscal obligations in Spain.
